Authorized access and contractual scope
Keith Knight Consultant Services provides association document access while your assigned membership and the association’s accounting contract remain active. An ongoing contract without an end date has no automatic expiry. Website access is a convenience and a privilege subject to authorization. Unless expressly included in a signed agreement, it does not create a separate contractual entitlement or expand the agreed scope of accounting services. Access may be limited, suspended, or discontinued for maintenance, security, misuse, or service changes, subject to applicable law and any signed agreement. A signed agreement controls if it conflicts with these website terms.
Access does not authorize sharing private board records with others. Protect your sign-in and report unauthorized access. HOA representatives are responsible for reviewing the homeowner financial PDF and uploading it to their HOA website. Reserve forecasts are planning tools based on supplied assumptions.
Errors, reliance, and availability
Keith Knight and Keith Knight Consultant Services can make mistakes. Website information may contain errors, omissions, outdated material, or incomplete information. Verify important figures, deadlines, and assumptions with Keith before making decisions, and report suspected errors promptly. Website material does not expand the services in a signed engagement agreement.
The website is provided on an “as is” and “as available” basis. To the extent permitted by law and consistent with any signed agreement, no warranty is made that the website will always be accurate, complete, current, secure, uninterrupted, or free of technical errors. Maintenance, outages, third-party failures, and other interruptions may prevent access. Keep appropriate copies of records you are authorized to download.
Website liability limitations
To the extent permitted by applicable law and consistent with any signed agreement, Keith Knight Consultant Services and Keith Knight disclaim implied warranties concerning the website, including merchantability and fitness for a particular purpose, and will not be liable for indirect, incidental, special, consequential, or punitive damages arising from website use, reliance on website material, or inability to access the website, including lost profits or business interruption.
These limitations do not exclude liability for fraud, intentional misconduct, gross negligence, or any liability or right that applicable law does not allow to be excluded or waived. They do not release obligations under a signed accounting services agreement. These terms are not a blanket prohibition on bringing a legal claim.
Ownership and permitted use
Keith Knight Consultant Services owns the website design, software, branding, and original content it creates, except where a signed agreement or third-party license provides otherwise. Client-supplied records and third-party materials remain the property of their respective owners. Uploading a file does not transfer ownership to the business. Ownership and delivery of client reports and other work products follow the signed engagement agreement.
Authorized users may view and download material only as their assigned permissions and agreement allow, for the association’s legitimate business. Do not redistribute private records, resell business-created material, remove ownership notices, or copy the website’s branding or design without permission. Download access does not transfer intellectual property rights.
Contract changes and file return
Contact contact@consultant-services.org to request a contract change or extension. A request alone does not alter agreed terms or extend access. Before ending services, confirm the records to be returned and the authorized recipient, arrange secure delivery, and confirm receipt before removing access, subject to the agreed termination date. Retained records follow the agreed retention policy and applicable holds.
